Fla. Stat. 581.217(3)(e) defines hemp by 'total delta-9-tetrahydrocannabinol concentration' at or below 0.3%, and 581.217(12)(a) requires testing by 'post-decarboxylation or other similarly reliable methods' — which converts THCA and therefore counts it. Florida has been a total-THC state by statute the whole time. FDACS red-tags THCA flower even when the raw delta-9 figure complies. Non-smokable products under the caps are still sold.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
