Md. Code, Alcoholic Beverages & Cannabis 36-1102(b)(1) provides that a person 'may not sell or distribute a product intended for human consumption or inhalation that contains more than 0.5 milligrams of tetrahydrocannabinol per serving or 2.5 milligrams of tetrahydrocannabinol per package' unless licensed. No high-potency flower meets that ceiling. The caps took effect July 1, 2023 and became enforceable when the Appellate Court of Maryland reversed the injunction against them on September 9, 2025. Hemp tinctures at a 15:1 CBD-to-THC ratio remain available.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
