21.20.3.7(J) NMAC, in the rule governing hemp manufacturing, defines the operative term outright: 'THC means delta-9-tetrahydrocannabinol as measured using a post-decarboxylation method and based on percentage dry weight.' Post-decarboxylation converts THCA before measurement, so high-THCA flower cannot meet the 0.3% ceiling in 21.20.3.7(D). The cultivation rule matches at 21.20.2.12 ('post decarboxylation'). New Mexico's licensed adult-use dispensaries are the channel for high-THCA flower.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
