Since July 1, 2026, when the last Department of Agriculture legacy licenses expired, hemp retail runs entirely under T.C.A. Title 57 chapter 7. It is an offense under 57-7-114 to sell hemp or a hemp-derived cannabinoid product with a total THC or total theoretical THC content above three-tenths of one percent, computed as delta-9 plus 0.877 times THCA, which ends flower, pre-rolls and concentrates. TABC-licensed 21-and-over retail — roughly 1,300 licensees — still sells edibles at 15 mg per serving, tinctures, beverages and 500 mg cartridges. No direct-to-consumer shipping into the state.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
