DSHS rules (25 TAC ch. 300) define total delta-9 THC as (0.877 × THCA) + delta-9, which no natural THCA flower can pass — flower testing 20-30% THCA calculates well above the 0.3% limit. Flower, pre-rolls, and concentrates are out; non-smokable hemp under 0.3% delta-9 is still sold. The rules are in force but under appeal.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
