THCa in New York: Restricted
N.Y. Cannabis Law 3(53) defines total THC as (THCA x 0.877) + THC and 9 NYCRR 114.8 caps hemp at 0.3% of it, bans pre-rolls, cigarettes and inhalers outright, and limits oral products to 1 mg per serving and 10 mg per package.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
