THCa in Pennsylvania: Restricted
Pennsylvania has no statutory hemp definition that governs consumer products. The only one, 3 Pa.C.S. 702, is prefaced 'when used in this chapter' and belongs to the Industrial Hemp Research chapter, which 3 Pa.C.S. 710 sunsets on publication of the 703(c) notice. The Controlled Plant and Noxious Weed Act definitions at 3 Pa.C.S. 1502 contain no hemp entry, while 1512(b) and 1515(c) require a permit to retail, hold or display a controlled plant. The retail question therefore has no clear statutory answer; this row rests on that absence and suppresses nothing.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
