Under appealD.C. Code 48-901.02(3)(A) defines marijuana as the leaves, stems, flowers and seeds of any Cannabis species. The section contains no hemp exemption and no THC threshold at all, and ABCA treats hemp cannabinoids as cannabis requiring a license — it has closed a large number of storefronts. The position is under federal and Superior Court challenge, so treat this row as provisional.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
