Under appealD.C. has no hemp definition and no THC threshold anywhere in its code. Section 48-901.02(3)(A) makes the flowers of any Cannabis plant marijuana, and (3)(B) makes resin and every derivative of resin hashish — both are cannabis, so extracts get no benefit from the resin carve-out in the marijuana definition. ABCA enforces on that basis and has closed a large number of storefronts. Capitol Hemp v. District of Columbia (No. 2025-CAB-008208) and Capitol Hemp v. United States (No. 1:25-cv-01797, D.D.C.) are pending.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
