902 KAR 45:012 requires a CHFS retailer permit (21+, school buffer) and 902 KAR 45:021 sets manufacturing and milligram labeling standards. Delta-9 at or below 0.3% total THC is an allowed adult-use cannabinoid, so this is a licensing regime rather than a ban, but high-THCA flower is not clearly permitted. Provisional.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
