MCL 333.27953(aa)(i) defines THC to mean, among other things, 'Tetrahydrocannabinolic acid' — so THCA counts by statute, not merely by agency interpretation, and THCA flower above 0.3% total THC is marihuana. It may be sold only by CRA-licensed retailers, not hemp shops.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
