RSA 439-A:2, V defines hemp on a delta-9-only basis, but RSA 439-A:4 provides that nothing in the chapter authorizes sale of hemp-derived products containing THC 'greater than 0.3 percent on a dry weight basis, which appear in any formulation, including delta-8 THC, delta-9 THC, or any other THC isomer variant'. The marijuana carve-out at RSA 318-B:2-c, I(a) reaches only hemp 'grown, processed, marketed, or sold under RSA 439-A', and RSA 318-B:1's cannabis-type drug definition carries no hemp exemption at all. New Hampshire has no adult-use retail channel.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
