THCa in West Virginia: Legal
W. Va. Code 19-12E-3 caps hemp at 'no greater than 0.3% tetrahydrocannabinol' — unqualified, not delta-9 specifically — with no post-decarboxylation requirement stated, and it cross-references 7 U.S.C. 5940, which has been superseded. On the plain text THCA is tetrahydrocannabinolic acid rather than tetrahydrocannabinol, so flower complies, but the ambiguity is unresolved and could be read the other way.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.

UPDATE definitely one of the worst dispensary in town. When I first made the post I just got my card. 2 years in and this place has not only crappy smoke but crappy rewards with low stock! I can’t express how amazing this place is. Being a newbie today I had few questions, they was answered and explained!! They had an amazing selection with deals like no other in Huntington. Price was even better I walked out feeling like Snoop. Must visit!!
