11 AAC 40.400(d) bars the state from endorsing any consumable hemp product containing delta-9 THC, measured post-decarboxylation so THCA counts — flower, vapes, edibles and tinctures alike. Intoxicating product is AMCO-licensed-store-only. Upheld in the District of Alaska in May 2025.
Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
