Is THCa legal in my state?

The legality of THCa varies by state and is subject to change. Here’s the general framework:

Federal Law: Under the 2018 Farm Bill (Agriculture Improvement Act of 2018), hemp-derived products containing less than 0.3% Delta-9 THC by dry weight are federally legal. The USDA Hemp Program oversees federal hemp regulations. Most THCa products fall under this definition.

State Laws Vary:

  • Some states have explicitly legalized hemp-derived cannabinoids
  • Others have restricted or banned certain cannabinoids
  • A few states have no specific regulations

Always check your local laws before purchasing. Regulations can change quickly, and what’s legal in one state may not be in another.

We recommend verifying with your state’s agriculture or health department for the most current information.
