Sub. S.B. 56 redefined hemp by 'a total tetrahydrocannabinols concentration' including THCA effective March 20, 2026, treats anything above 0.4 mg total THC per container as marijuana, and moves intoxicating hemp behind Division of Cannabis Control dispensary licensing. The hemp-beverage carve-out was line-item vetoed. Important: the act was partly enjoined on July 13, 2026 in the Northern District of Ohio and the state's appeal is pending before the Sixth Circuit as No. 26-3648, so this row could move.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
