G.S. 90-87(16) excludes 'hemp or hemp products' from the definition of marijuana, and 90-87(13a) defines hemp by 'a delta-9 tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis' — delta-9 alone, with no post-decarboxylation requirement. The largest verified legal market remaining.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
