A.R.S. 3-311 defines industrial hemp by delta-9 THC alone at 0.3% dry weight, with no post-decarboxylation requirement, so the hemp statute does not by itself reach THCA. But neither A.R.S. 13-3401 nor 36-2801 carves industrial hemp out of the definition of marijuana, and AG Opinion I24-005 addresses hemp-synthesized intoxicants such as delta-8 rather than naturally occurring THCA. A preliminary-injunction denial is on appeal, so the retail question is genuinely open.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
