Intoxicating hemp may be sold only by MCA-licensed cannabis businesses; unlicensed retail is capped at 0.5 mg total THC per serving and 2.5 mg per package. The Appellate Court of Maryland lifted the injunction against enforcement on September 9, 2025.

Separately, the federal hemp definition changes on November 12, 2026, when total THC replaces delta-9 as the test and finished products are capped at 0.4 mg of total THC per container. That applies nationwide regardless of state law.
